McKeen and Associates Wins Genesys Medical Malpractice Appeal
Justice was served for a mother and her injured infant in Flint, Michigan on April 9 as McKeen and Associates won an appeal filed by Genesys Regional Medical Center. Genesys lost the medical malpractice suit at the Circuit Court level and challenged the $2.9M verdict. What follows is a press release from McKeen and Associates, detailing this victory.“State Court of Appeals finds Genesys Regional Medical Center culpable in infant’s injury.McKeen & Associates announced it won an appeal Genesys Regional Medical Center filed against the jury verdict of $2.9 million in a medical malpractice the law firm won on behalf of Libbey Bryson, a Flint mother whose baby suffered permanent injury to her brachial plexus during delivery.The State of Michigan Court of Appeals upheld the Circuit Court for the County of Genesee’s decision that Genesys’s practicing resident physicians were responsible for the infant’s injury. Bryson, who was suffering from influenza, had her labor induced and shoulder dystocia (when an infant’s shoulder is stuck in vaginal canal) was encountered. The infant suffered her injury due to excessive force and traction during the delivery. Due to the birth injury, the child suffers from severe limitations in strength, range of motion and impairment of manual dexterity. Richard Counsman and Brian McKeen tried the case.
